In between finding a right to an abortion and the right of foreign terrorists to clog up our courts, the Supreme Court has finally noticed the Second Amendment. Heller opinion here. Scalia, thank God, wrote the opinion and didn’t muck it up with weasel-worded balancing tests.
This is an incredibly happy day for gun owners and all real Americans. It’s a testament to the power of scholarship. Twenty years ago the consensus position was the Second Amendment was effectively meaningless. Don Kates, Sanford Levinson, Akhil Amar, and Stephen Halbrook deserve a lot of the credit for undermining this unthinking consensus.
